摘要: 外国人在中国申请永久居留须知

一、受理条件

(一)基本条件

(1)遵守中国法律。是指申请时无未了结的刑事案件以及需要追究行政违法责任但尚未处理等情形的;在中国无犯罪记录;无其他情节较重或性质恶劣的违法行为;

(2)身体健康。是指申请时无精神病和艾滋病、性病、开放性肺结核病等国家法定传染性疾病且生活能够自理;有其他疾患生活不能自理但不会增加社会负担;

(3) 无犯罪记录。是指申请人在境外的主要生活地以及在我国国内均没有犯罪行为的记录。“主要生活地”是指连续居留2年以上的国家或地区。

(二)分类条件

1、在中国直接投资、连续三年投资情况稳定且纳税记录良好的。(投资人员类)

“直接投资”是指外国投资者个人在我国国内通过设立外商投资企业、与中方投资者共同进行石油的合作勘探开发等方式进行投资。投资既包括以人民币、美元等现金形式投资,也包括以技术、专利以及设备等形式投资,不包括个人从事房屋、股票、有价债券买卖、交易等投资活动。

   “连续三年投资情况稳定”是指申请时以及申请之日前连续3年内投资者实际缴付的注册资本金(“实际缴付的注册资本金”指实际已到位的资金)合计不得低于规定标准。

对在中国投资实际缴付的注册资本金规定标准如下:(1)在国家颁布的《外商投资产业指导目录》鼓励类产业投资合计50万美元以上;(2)在中国西部地区和国家扶贫开发工作重点县投资合计50万美元以上;(3)在中国中部地区投资合计100万美元以上;(4)在中国投资合计200万美元以上。

 “纳税记录良好”是指按照我国有关法律已全部缴纳规定的税款,包括个人所得税、城市房地产税、车船使用牌照税、印花税、契税等。

2、在中国担任副总经理、副厂长等职务以上或者具有副教授、副研究员等副高级职称以上以及享受同等待遇,已连续任职满四年、四年内在中国居留累计不少于三年且纳税记录良好的。(任职人员类)

任职人员所在的任职单位应当符合下列条件之一:(1)国务院各部门或者省级人民政府所属的机构;(2)重点高等学校;(3)执行国家重点工程项目或者重大科研项目的企业、事业单位;(4)高新技术企业、鼓励类外商投资企业、外商投资先进技术企业或者外商投资产品出口企业。

此类人员申请时及申请之日前连续4年内应同时具备任职单位、职务(职称)、居留期限等各相关条件。该期限内变换工作单位或职务、职称的,变动情况应符合相关规定条件。

3、对中国有重大、突出贡献以及国家特别需要的。(特殊人员类)

“对中国有重大、突出贡献以及国家特别需要的人员”统称特殊人员,是指对国家经济发展和社会进步做出过重大、突出贡献或对国家有重大价值的世界顶尖人才、特殊技能人才及知名人士等,包括世界著名科学奖项获得者、世界知名学者、企业家、运动员、文艺人士等。

4、上面三类条件所指人员的配偶及其未满18周岁的未婚子女。(投资、任职及特殊人员的随行家属类)

此类人员可与投资、任职人员以及特殊人员同时申请,也可在投资、任职人员以及特殊人员被批准在中国永久居留后提出申请。

5、中国公民或者在中国获得永久居留资格的外国人的配偶,婚姻关系存续满五年、已在中国连续居留满五年、每年在中国居留不少于九个月且有稳定生活保障和住所的。(夫妻团聚类)

“中国公民”是指具有中国常住户籍的中国公民。

夫妻团聚人员申请时应仍存在婚姻关系。申请之前申请人在华合法短期停留或留学、任职等居留的时间可计入本条规定的居留期限。

6、未满18周岁未婚子女投靠父母的。(亲子团聚类)

亲子团聚人员申请时其父母至少有一方为中国公民或为具有中国永久居留资格的外国人。

“中国公民”是指具有中国常住户籍的中国公民。

7、在境外无直系亲属,投靠境内直系亲属,且年满60周岁、已在中国连续居留满五年、每年在中国居留不少于九个月并有稳定生活保障和住所的。(亲属投靠类)

亲属投靠人员申请时应年满60周岁且申请之日前连续5年内应同时具备其他各相关规定条件。申请之前曾在华合法停留或在华留学、任职等居留的时间可计入本条规定的居留期限。

注:本条所指年限均指申请之日前连续的年限。

、申请材料

(一)申请基本材料:

1、有效的外国护照或者能够代替护照的证件;

2、住宿登记证明;

3、中国政府指定的卫生检疫部门出具的或者经中国驻外使、领馆认证的外国卫生医疗机构签发的合法的、有效的健康证明书(“健康证明书”是申请人在申请前6个月内进行身体检查);

4、经中国驻外使、领馆认证的国外无犯罪记录证明;

5、四张二英寸近期正面免冠彩色照片;

(二)按分类条件须提交材料:

1投资人员类

须提交外商投资企业批准证书、登记证明以及联合年检证明(“联合年检证明”是外经贸、工商、税务、海关、外汇等部门对外商投资企业联合进行的年检证明)、验资报告、个人完税证明(“个人完税证明”指申请条件中规定期限内申请人缴纳全部税款的凭证)。

鼓励类外商投资企业还应当提交国家鼓励发展的外商投资项目确认书。

2任职人员类

须提交下列材料:

(1)任职单位出具的本人职务或者职称证明;

(2)《外国专家证》或者《外国人就业证》;

(3)任职单位的登记证明以及年检证明(“年检证明”是指有关主管部门对除外商投资企业以外的其他企业或有关事业单位颁发的登记证明进行的年检证明)、个人完税证明(“个人完税证明”指申请条件中规定期限内申请人缴纳全部税款的凭证);任职单位是外商投资企业的,还需提交外商投资企业批准证书和联合年检证明;

(4)在执行国家重点工程项目或者重大科研项目的企业、事业单位中任职的人员需提交省、部级政府主管部门出具的项目证明文件;在高新技术企业中任职的人员需提交高新技术企业证书;在鼓励类外商投资企业、外商投资先进技术企业或者外商投资产品出口企业中任职的人员需提交国家鼓励发展的外商投资项目确认书或者外商投资先进技术企业确认书或者外商投资产品出口企业确认书。

3特殊人员类

须提交中国政府主管部门出具的推荐函及有关证明(“推荐函及有关证明”是指国务院所属主管部、委、局出具的推荐函、国家主管部门颁发的在华居住证件、奖励证明以及申请人获得的具有世界影响力或重大价值的科研成果证明等。根据有关规定,外籍华人科技人才可由人事部确认并推荐,由人事部出具推荐函或身份确认函以及《来华定居专家证》确认)。

此类人员无须提供健康证明以及无犯罪记录证明。

4、投资、任职及特殊人员的随行家属类

属于配偶的,还须提交婚姻证明;属于未满18周岁未婚子女的,还须提交本人出生证明或者亲子关系证明;属收养关系的,还须提交收养证明。外国有关机构出具的上述证明须经中国驻该国使、领馆认证。

注:未满18周岁未婚子女无须提供健康证明以及无犯罪记录证明。

5、夫妻团聚类

须提交其中国籍配偶的常住户籍证明或者其外国籍配偶的《外国人永久居留证》、婚姻证明、经公证的生活保障证明(“生活保障证明”指按照受理机关所在地每月最低生活保障金数额为标准,有相当于10年以上存款数额的可支配财产或受理申请后5年内较稳定的每月不低于该标准的个人收入来源证明)及房屋租赁或者产权证明。外国有关机构出具的上述证明需经中国驻该国使、领馆认证。

6、亲子团聚类

须提交其中国籍父母的常住户籍证明或者外国籍父母的《外国人永久居留证》、本人出生证明或者亲子关系证明;属收养关系的,还需提交收养证明。外国有关机构出具的上述证明需经中国驻该国使、领馆认证。

7、亲属投靠

须提交被投靠的中国公民常住户籍证明或者外国人的《外国人永久居留证》、经公证的亲属关系证明以及投靠人国外无直系亲属关系证明、经公证的投靠人经济来源证明(“经济来源证明”指按照受理机关所在地每月最低生活保障金数额为标准,有相当于10年以上存款数额的可支配财产或受理申请后5年内较稳定的每月不低于该标准的个人收入来源证明)或者被投靠人经济担保证明、经公证的投靠人或者被投靠人的房屋租赁或者产权证明。外国有关机构出具的上述证明需经中国驻该国使、领馆认证。

三、《外国人永久居留证》的效用和有效期

《外国人永久居留证》是获得在中国永久居留资格的外国人在中国境内居留的合法身份证件,可以单独使用。获得在中国永久居留资格的外国人,凭有效护照和《外国人永久居留证》出入中国国境。

《外国人永久居留证》的有效期为五年或十年。被批准在中国永久居留的未满18周岁的外国人,发给有效期为五年的《外国人永久居留证》;被批准在中国永久居留的18周岁以上的外国人,发给有效期为十年的《外国人永久居留证》。

四、《外国人永久居留证》的申请

申请在中国永久居留人员由本人向公安机关提出申请并办理相关手续,也可以委托其亲属以及国家机关、律师事务所等有关法人机构代理申办手续(统称“被委托人”)。未满18周岁的申请人应由其父母代理申办手续,其父母也可委托上述人员或机构代为申请。

委托国家机关或有关法人机构申请的,需有申请人本人或未满18周岁未婚子女的父母书写并签字的委托书。委托书应注明申请人与被委托人的基本情况、委托事项等内容,具体承办人需有被委托机构的授权书。委托亲属申请的,委托书还应注明申请人与被委托人关系以及委托理由等内容。

五、《外国人永久居留证》的受理机关

在华投资的外国人申请在中国永久居留,由申请人投资数额最多的投资地公安机关受理;对在华任职的,由申请人长期居留地公安机关受理,居住地与工作地不在同一地区的,可由任职单位所在地公安机关受理;特殊人员由申请人拟永久居留地的公安机关受理;上述人员的配偶或子女、夫妻团聚、亲子团聚以及亲属投靠的,由有关中国公民户籍所在地或具有中国永久居留资格的外国人长期居留地公安机关受理。

申请换发或补发证件的,由原受理机关受理,对长期居留地确已发生变化的,也可由现居住地公安机关受理。

七、审批时限

公安机关自受理外国人在中国永久居留的申请之日起六个月以内做出批准或者不批准的决定。

八、《外国人永久居留证》的换发和补发

《外国人永久居留证》有效期满、内容变更、损坏或者遗失的,持证人应当向其长期居留地公安机关申请换发或者补发。

持有《外国人永久居留证》的外国人应当在证件有效期满前一个月以内申请换发;证件内容变更的,应当在情况变更后一个月以内申请换发;证件损坏或者遗失的,应当及时申请换发或者补发。

九、永久居留资格的丧失

具有在中国永久居留资格的外国人有下列情形之一的,公安部可以取消其在中国永久居留资格,同时收缴其所持《外国人永久居留证》或者宣布作废:

1、可能对国家安全和利益造成危害的;

2、被人民法院判处驱逐出境的;

3、通过提供虚假材料等非法手段骗取在中国永久居留资格的;

4、未经批准每年在中国累计居留不满三个月或者五年内在中国累计居留不满一年的。

Guidance of Foreigners Applying for Permanent Residence

 

  1. Acceptance Conditions
    1. Basic Conditions

a.Abide by Chinese Laws.

The applicant should have at the time of application no unsettled criminal lawsuit or unsettled liabilities for administrative malfeasance; no criminal record in China; no other unlawful acts of vile nature or with rather serious circumstances;

b.Good Health.

The applicant should have at the time of application no mental disease or statutory infectious diseases such as AIDS, V.D., Open Tuberculosis, etc., and be able to take care of himself/herself in daily life; or the applicant may have other illness and can not take care of himself/herself in daily life but causes no burden to the society;

c.No Criminal Record.

The applicant should have no criminal record at his major place of living outside China or at any place in China. “Major place of living” refers to a country or region where the applicant has continuously lived for over 2 years.

  1. Categorized Conditions

a.Those who have direct investment in China, remain investment steady and keep a good tax-paying record during the past three continuous years. (Investors)

“Direct investment” refers to investment made by foreign individuals in China in the forms of setting up enterprises with foreign investment, joint exploration of petroleum with Chinese investors, etc. Investment can take the form of cash such as RMB and USD, as well as the forms of technology, patent, equipment, etc.. “Direct Investment” does not include investment in real estate, stock, or securities.

“Keep investment steady during the past three continuous years” means that in the past three continuous years by the time of application, the total of authorized capital actually paid (“authorized capital actually paid” refers to the capital actually in place) by the applicant is not lower than the fixed standards.

The standards for actually paid authorized capital by foreign investors are:

a.1. the total investment in any of the industries listed in the “Guiding Catalogue of Industries for Foreign Investors” issued by the national government is over USD 500,000.00;

a.2. the total investment in West China or in any other key poverty alleviating and development county of the country is over USD 500,000.00;

a.3. the total investment in Central China is over USD 1 million;

a.4. the total investment in China is over USD 2 million.

“Have a good tax-paying record” means that the applicant has paid all taxes as prescribed by Chinese laws, including individual income tax, taxes on buildings and estate, vehicle and vessel license and plate tax, stamp tax, deed tax and so on.

b.Working in China as deputy general managers, deputy factory  directors or on higher positions, or having titles not lower than associate professors and assistant senior researchers or their counterparts, and having been working for at least 4 continuous years. During the 4 years of work in China an applicant should have an accumulated tenure of residence in China of not less than three years and have a good tax-paying record. (Employees)

The unit where the applicant works should belong to one of the following types:

b.1. institutions directly under various ministries of the State Council or directly under provincial governments;

b.2. key universities;

b.3. enterprises or institutions undertaking national key engineering projects or key research projects;

b.4. hi-tech and neo-tech enterprises, government-encouraged enterprises with foreign investment, advanced technology enterprises with foreign investment and export enterprises with foreign investment.

The applicant should simultaneously meet such conditions as working unit, title (or position), tenure of residence and so on during the past 4 years by the time of application. If there has been change of working unit, title, or position, the changed conditions should meet the prescribed requirements.

c.People who have made outstanding contributions to China or who are especially needed by the country. (Special Personnel)

“People who have made outstanding contributions to China or who are especially needed by the country” are collectively called “special personnel”, referring to people who have made significant or outstanding contributions to the economic or social development of China; top talents of special significance to the world; people with special skills; or world famous people. “Special Personnel” include winners of world famous prizes for science, world renowned scholars, entrepreneurs, athletes, literary and art workers, and so on.

d.Spouses or unmarried children under 18 of the above listed three categories of applicants. (Accompanying family members of investors, employees or special personnel)

       Such applicants can apply together with above-listed investors, employees or special personnel. Or they can put forward their applications after investors, employees or special personnel have attained approval of permanent residence in China.

e.Spouses of Chinese citizens or of foreigners as permanent residents in China, whose marriage relations have lasted for at least five years, and have a continuous tenure of residence in China of not less than five years. During the five years of residence the applicants should have stayed in China for at least nine months annually and have steady sources of income and domiciles. (Couple Reunion)

“Chinese Citizens” refer to Chinese citizens with permanent household register in China.

The applicant should still be in marriage relation. The applicant’s lawful residence or tenure of study or work in China before application can be counted as part of the residence tenure prescribed in this article.

f.Unmarried children under 18 come to live with their parents.(Reunion of Parents and Children)

The applicant should have at the time of application at least one parent who is a Chinese citizen or a foreigner with the right of permanent residence in China.

“Chinese Citizen” refer to a Chinese citizen with permanent household register in China.

g.People who have no directly-related family members outside China and come to seek refuge with their directly-related family members in China. The applicants should be not younger than 60 and have a tenure of residence in China of at least five years, with an annual stay in China of not less than 9 months, and should have steady sources of income and domiciles. (Relatives Coming for Refuge)

The applicant should be at least 60 years old at the time of application and should simultaneously meet other prescribed conditions during the past 5 years by the date of application. The applicant’s lawful residence or tenure of study or work in China before application can be counted as part of the residence tenure prescribed in this article.

Note: the time limits mentioned in this article all refer to continuous terms before the date of application.

  1. Application Documents

1.Basic Application Documents

a.Valid foreign passports or valid certificates that can substitute for passports;

b.Certificates of accommodation registration;

c.lawful and valid certificates of health issued by health quarantine organizations appointed by the Chinese government or medical institutions outside China recognized by Chinese embassies or Consulates in those countries (“Certificates of health” are the results of physical examination during the past six months by the date of application);

d.no-crime records outside China approved by Chinese embassies or

consulates;

e.four recently taken two-inch, bare-headed, full-faced colour photos

2.Categorized Application Documents

a.Investors

Licenses of enterprises with foreign investment, registration certificates and joint annual examination certificates (a “joint annual examination certificate” is a certificate jointly issued by Foreign Economics and Trade Commision, Bureau of Industrial and Commercial Management, Tax Bureau, the Customs, Foreign Currency Management Bureau, etc.), capital assessment reports, individual duty-paid proof (“individual duty-paid proof” is a certificate showing that the applicant has paid all duties during the prescribed term).

       Investors of government-encouraged enterprises with foreign investment should provide project approval certificates issued by the government.

b.Employees

The following documents should be provided:

b.1. certificates of positions or titles issued by their employers;

b.2. Foreign Expert Certificates or Employment Certificates of Foreigners

b.3. registration certificates of working units and their annual examination certificates (“annual examination certificates” are certificates issued by responsible departments for the annual examination of registration certificates of institutions and enterprises other than enterprises with foreign investment), individual duty-paid proof (“individual duty-paid proof” is a certificate showing that the applicant has paid all duties during the prescribed term); in the case of employees in enterprises with foreign investment, licenses of the enterprises and joint annual examination certificates are needed;

b.4. Applicants working in enterprises or institutions undertaking national key engineering projects or key research projects should provide proof of project issued by province-level or ministry-level responsible departments; applicants working in hi-tech and neo-tech enterprises should provide certificates of hi-tech and neo-tech enterprises; applicants working in government-encouraged enterprises with foreign investment, advanced technology enterprises with foreign investment and export enterprises with foreign investment should respectively provide letters of project confirmation issued by the government, confirmation of advanced technology enterprises with foreign investment and confirmation of export enterprises with foreign investment made by the government.

c.Special Personnel

Applicants of this category should provide Letters of recommendation and relative certificates issued by responsible departments of the Chinese government (“letters of recommendation and relative certificates” refer to letters of recommendation provided by responsible ministries, commissions and bureaus under the State Council, residence certificates and prize-winner certificates issued by responsible departments of the Chinese government, and certificates of the applicants’ research achievements of world significance. According to relative regulations, overseas Chinese scientific and technological talents are identified and recommended by the National Personnel Department, and can be confirmed with letters of recommendation, letters of identity confirmation and “Certificate of Expert Coming to Reside in China”).

       Such Applicants do not need to provide health proof or no-crime records.

d.Investors, Employees, and Accompanying Family Members of Special Personnel

Spouses should provide marriage certificates; unmarried children under 18 should provide birth certificates or certificates of family relation; adopted children should provide certificates of adoption. Certificates mentioned above in this term which are issued by foreign responsible institutions should be confirmed by Chinese embassies or consulates in such countries.

       Unmarried children under 18 do not need to provide health proof or no-crime records.

e.Couple Reunion Applicants

Such applicants should provide their Chinese spouses’ certificates of permanent household register or their foreign spouses’ certificates of permanent residence, marriage certificates, notarized guarantee of living expenses (“guarantee of living expenses” shows that according to the lowest monthly guaranteed living expenses at the place of acceptance institution, the applicant has disposable property equal to not less than 10 years of deposit, or that the applicant has source(s ) of income not lower than the prescribed monthly income standard within five years after the acceptance of application), and certificates of house lease or certificates of house ownership. Certificates mentioned in this term issued by foreign responsible institutions should be confirmed by Chinese embassies or consulates in such countries.

f.Reunion of Parents and Children

This category of applicants should provide their Chinese parents’ certificates of permanent household register or their foreign parents’ certificates of permanent residence, birth certificates or certificates of family relation; adopted children should provide certificates of adoption. Certificates mentioned above in this term issued by foreign responsible institutions should be confirmed by Chinese embassies or consulates in such countries.

g.Relatives Coming for Refuge

Such applicants should provide their directly-related Chinese relatives’ Certificates of permanent household register or their directly-related foreign relatives’ certificates of permanent residence, notarized certificates of kinship relations and proof of the fact that such applicants have no directly-related relatives outside China, notarized certificates of sources of income (“proof of income source(s)” shows that according to the lowest monthly guaranteed living expenses at the place of acceptance institution, the applicants has disposable property equal to not less than 10 years of deposit, or that the applicant has source(s ) of income not lower than the prescribed monthly income standard within five years after the acceptance of application), or financial warranty provided by the applicants’ relatives, or the applicants or their relatives’ certificates of house lease or certificates of house ownership. Certificates mentioned above in this term issued by foreign responsible institutions should be confirmed by Chinese embassies or consulates in such countries.

  1. Procedures and Time Limits

Acceptance of application for permanent residence in China by foreigners (Acceptance institutions: public security organizations under municipal governments,   public security subbureaus and county public security bureaus in municipalities directly under the central government)→Examination of foreigners’ application for permanent residence (Examining institutions: public security departments and bureaus under provincial government, autonomous region government or municipality directly under the central government) →Examination and approval of foreigners’ application for permanent residence (approval institution: the Ministry of Public Security).

      Public security organizations should make the final decision of approval or disapproval within six months after acceptance of application for permanent residence in China by foreigners.

IV.Loss of the Right of Permanent Residence

In any of the following cases, the Ministry of Public Security can deprive

foreigners of their right of permanent residence in China, and take back or abolish their “Certificates of Permanent Residence for Foreigners”:

  1. possible to cause harm to national security or interests;
  2. sentenced by people’s courts to be deported;
  3. obtaining the right of permanent residence in China by providing falsified application documents;
  4. staying in China every year for less than three months without being approved by responsible institutions, or having an accumulated stay in China of less than one year during five years.
